Hi all,

Did you know that your private health and financial information may be sent to Pakistan and other foreign countries without your knowledge?

Have you read stories about US active duty soldiers' confidential information being in the hands of Pakistani transcriptionists?

Current HIPAA laws to not prohibit this, nor do they require your doctor to obtain your authorization before shipping your information overseas.

Even more scary is that outside billing/transcription companies are not "covered entities".... The HIPAA Privacy Rule applies only to "covered entities" (medical providers, insurance companies, and clearinghouses). It does NOT apply to their business associates (outside billing companies, transcription services, etc.)

Covered entities can not be held liable for violations of their business associates and they are not required to monitor the actions of their business associates.

So, basically, a billing company in Pakistan could release US citizens' PHI to a terrorist group and nobody would be held liable.

There is something wrong with this picture!

We need to urge Congress to amend HIPAA!
